HB 2283 Summary

• Amends definition of "sexual contact" to exclude direct or indirect touching during caretaking responsibilities or normal and reasonable interactions that an objective, reasonable person would recognize as appropriate under the circumstances.

• Removes the defense to prosecution for sexual conduct that the defendant was not motivated by sexual interest for offenses under sections 13-1404 and 13-1410.

• Establishes an affirmative defense for individuals under 19 years old (or still attending high school) who are no more than 24 months older than a victim aged 15-17 if the conduct is consensual and applies to prosecutions under sections 13-1405 and 13-3560.

• Renumbers subsection E to subsection F in section 13-1407 regarding defenses to sexual offenses involving minors.

• Applies the close-in-age defense to aggravated luring a minor for sexual exploitation prosecutions under section 13-3560.
