HB 2386 Summary

• Amends Arizona Revised Statutes section 12-821.01 to modify requirements for claims filed against public entities, public schools, or public employees.

• Requires claims to be filed within 180 days after the cause of action accrues and must contain facts sufficient to establish liability basis, a specific dollar amount for settlement, and facts supporting that amount.

• Clarifies that a cause of action accrues when the damaged party realizes they have been damaged by a final official act and knows or reasonably should know the cause of that damage.

• Deems a claim automatically denied 60 days after filing unless the claimant receives written denial notice before expiration of that period.

• Applies retroactively to claims filed after July 1, 2016, with all claims to be adjudicated under the amended requirements as if timely filed from March 31, 2018 forward.
