HB 2468 Summary

• Repeals and replaces the state personnel system (Title 41, Chapter 4, Articles 4-5) with new articles establishing the director of administration's authority over personnel administration, classification, compensation, and disciplinary procedures for covered state employees.

• Reduces the suspension threshold triggering state personnel board appeal rights from more than 80 working hours to more than 40 working hours for covered employees challenging dismissal, suspension, or involuntary demotion.

• Revises the state personnel board's appellate standard to allow reversal of agency disciplinary action only if arbitrary, capricious, or contrary to law, and permits penalty modification only if disproportionate to the proven offense in light of mitigating circumstances.

• Establishes a special market adjustments committee and system to modify salaries for critical state positions experiencing high turnover or below-market compensation, subject to legislative appropriation.

• Makes conforming amendments to provisions affecting school teachers, military service leave, retirement system compensation, whistleblower protections, procurement officer employment restrictions, and law enforcement merit system appeals.
