Cities and towns are prohibited from imposing taxes, fees, assessments, or charges on consumers or businesses to fund drug disposal programs, and cannot require businesses to establish or operate such programs.

Counties are prohibited from imposing taxes, fees, assessments, or charges on consumers or businesses to fund drug disposal programs, and cannot require businesses to establish or operate such programs, though counties may still comply with existing requirements to establish at least one drug disposal drop-off location.

Drug disposal programs established by private businesses that comply with state and federal law are declared a matter of statewide concern and cannot be further regulated by cities, towns, or counties.

The state Department of Health Services must enter into a public-private partnership by January 1, 2019 to develop an education and awareness program on safe drug disposal, including a web-based resource with searchable drug disposal sites and events, and information on proper storage and disposal methods.

A drug disposal education and awareness fund is established to accept donations from private persons or organizations, with monies used to administer the education and awareness program.
