HCR 2001 Summary

• Requires all firearm sales or transfers to be conducted through a licensed firearms dealer, with limited exceptions for law enforcement, military, and certain other situations.

• Licensed dealers must conduct federal background checks (18 U.S.C. § 922(t)) on purchasers and can charge a fee not to exceed $20 to cover administrative costs.

• Exempts transfers including: family gifts (spouses, parents, children, siblings, grandparents, grandchildren, nieces, nephews, first cousins, aunts, uncles), temporary transfers to prevent imminent death or great bodily harm, loans at shooting ranges, and loans for lawful hunting or sporting purposes.

• Exempts law enforcement, armed forces, corrections officers, gunsmiths performing repairs, common carriers, and antique firearms manufactured in or before 1898.

• Violations are classified as a Class 5 felony; the measure must be submitted to voters at the next general election for approval.
