AZ HCR2008

Proposes a constitutional amendment to Article IV, Part 1, Section 1 of the Arizona Constitution regarding the initiative process.

Adds new subsection (10) requiring the Attorney General to determine whether any initiative petition is preempted by or conflicts with federal law after circulation begins and before ballot certification.

Mandates that if the Attorney General finds an initiative measure is preempted by or conflicts with federal law, the initiative shall be disqualified and removed from the ballot.

Requires submission of the proposed amendment to Arizona voters at the next general election per Article XXI of the Arizona Constitution.
