SB 1074 Summary

• Repeals Title 11, Chapter 7, Article 8 of Arizona Revised Statutes and sections 13-1509, 13-2928, 13-2929, and 41-1724, eliminating certain immigration-related provisions and associated funding mechanisms.

• Removes from section 13-2319 (smuggling statute) the provision allowing peace officers to stop any person operating a motor vehicle based on reasonable suspicion of civil traffic law violations.

• Eliminates from section 13-3883 the authorization for peace officers to arrest without a warrant any person believed to have committed a public offense making them removable from the United States.

• Removes entrapment defense provisions from sections 23-212 and 23-212.01 (unauthorized alien employment laws) and modifies probationary period requirements from three years to five years for intentional violations.

• Repeals provisions in section 28-3511 authorizing vehicle removal and impoundment for transporting or harboring aliens in the United States illegally, and repeals the gang and immigration intelligence team enforcement mission funding mechanism established in section 41-1724.
