• Establishes that home-based businesses are permitted uses by right in residential dwellings, subject to deed restrictions and homeowners association rules.

• Prohibits municipalities and counties from requiring permits, licenses, or prior approval for "no-impact home-based businesses" that meet specified criteria including limited employees (residents, immediate family, and up to three non-residents) and activities conducted inside the dwelling without generating on-street parking or visible street presence.

• Allows municipalities and counties to establish narrowly tailored regulations for public health and safety, residential compatibility, and to prohibit illegal drugs, liquor sales, sober living homes, pornography, obscenity, and adult-oriented businesses.

• Prohibits municipalities and counties from requiring property rezoning for commercial use, home-based business licensing, or fire sprinkler installation in single-family or duplex dwellings as conditions of operating a home-based business.

• Designates compliance with these regulations as a judicial question, requiring municipalities and counties to prove by clear and convincing evidence that any regulation complies with the statute.
