SB 1193 - Overtime Pay

• Establishes minimum salary requirements for employees to qualify as exempt from overtime pay in administrative, executive, or professional capacities under federal fair labor standards.

• Sets the initial minimum weekly salary at the fortieth percentile of weekly earnings of full-time nonhourly workers in the lowest-wage census region, based on U.S. Department of Labor data from the second quarter of the year before implementation.

• Exempts teachers, licensed medical professionals, licensed attorneys, and other professionals from the new salary requirements if they would not have been subject to salary thresholds under 2015 U.S. Department of Labor regulations.

• Requires the commission to adjust the minimum salary amount every three years beginning January 1, 2021, based on updated labor statistics data using the same fortieth percentile calculation method.

• Authorizes the commission to adopt rules necessary to implement the salary requirements and exemptions.
