SB1394 Summary

• Expands abortion reporting requirements to include detailed information about reasons for abortion (elective, maternal health, fetal health, sexual assault, incest, coercion, sex trafficking, domestic violence) and specific medical complications (shock, uterine perforation, hemorrhage, infection, sepsis, incomplete abortion, uterine damage, failed termination, or death).

• Requires physicians performing abortions to report gestational age, procedure type, physician specialty, type of admission (outpatient clinic/hospital or inpatient), anesthesia administration to mother and fetus, and certifications regarding whether fetus was delivered alive.

• Creates new reporting requirement (section 36-2162.01) for physicians providing informed consent information or fetal ultrasound services to report the number of women receiving such services and number of abortions performed under medical emergency exceptions.

• Requires hospitals and facilities to request abortion reason information from women in private and provide information about reporting crimes to law enforcement and available resources if woman discloses abortion due to sexual assault, incest, coercion, sex trafficking, or domestic violence.

• Mandates all abortion reports be filed electronically to department of health services within 15 days after each month ends, with department publishing comprehensive annual statistical report while maintaining patient confidentiality; establishes penalties for unlawful disclosure and willful reporting violations.
