AZ SB1400

Allows sheriffs in counties with populations under 500,000 to establish aggravated DUI jail programs where mandatory prison sentences can be served in county jail instead, subject to state corrections department agreement.

Requires county sheriffs operating aggravated DUI jail programs to submit annual reports to the Arizona Criminal Justice Commission containing recidivism data.

Directs the Arizona Criminal Justice Commission to submit annual recidivism reports to the legislature comparing recidivism rates between persons serving mandatory incarceration in county jails versus prison, effective January 1, 2019.

Permits cities, towns, and counties to establish minimum or medium security facilities for persons convicted of DUI violations under sections 28-1381, 28-1382, and 28-1383.

Authorizes judges to order DUI offenders sentenced under these sections to serve sentences in minimum or medium security facilities if one has been established locally.
