SB 1401 Summary

• Adds new definition of "circumvent" to cover bypass attempts of ignition interlock devices, including bump starting vehicles, false breath samples, contaminated samples, blocking digital identification, operating with excessive alcohol, driving without the device, and allowing others to provide breath samples.

• Requires ignition interlock device manufacturers (rather than service providers) to electronically report device data to the Department of Transportation in real time daily, including tampering, circumvention attempts, compliance failures, alcohol concentration violations, and rolling retest failures.

• Establishes that all device repairs and modifications must be performed only by the manufacturer, and all required reporting under the chapter must originate from the device manufacturer.

• Modifies service provider contract requirements to clarify manufacturer responsibilities for device maintenance, reporting, and service center operations across Arizona counties.

• Applies retroactively from June 30, 2018.
