Establishes a dredge and fill permit program under Arizona Department of Environmental Quality authority to implement the federal Clean Water Act Section 404 permit program for discharging dredged or fill material into navigable waters.

Creates definitions and regulatory framework for compensatory mitigation, mitigation banks, and in-lieu fee programs to offset unavoidable impacts to navigable waters authorized by permits.

Authorizes the department to issue individual permits, general permits, and emergency permits for dredge and fill activities, and establishes procedures for jurisdictional determinations of navigable waters.

Requires approved jurisdictional determinations to be appealable agency actions by parties affected by the determination, while preliminary determinations are not appealable to adjacent landowners or third parties.

Applies conditional repeal on August 1, 2023 unless the EPA approves Arizona's dredge and fill permit program under the Clean Water Act by that date.
