SB 1532 Summary

• Allows individuals holding commercial driver licenses to attend defensive driving school when cited for civil traffic moving violations while driving non-commercial vehicles (Class D or Class M licensed vehicles).

• Requires courts to forward violation records for commercial driver license holders to the Department of Motor Vehicles, which must include the violation on their driving record but cannot use it to suspend or revoke their license.

• Permits commercial driver license holders who successfully complete defensive driving school to avoid civil penalties for the traffic citation and receive equivalent treatment to dismissed citations for private passenger vehicle insurance purposes.

• Imposes a $5 surcharge on all defensive driving school attendees (including commercial license holders) to be deposited in the judicial collection enhancement fund.

• Effective date: August 31, 2019.
