Urges United States Congress to enact the Nogales Wastewater Fairness Act to address border sanitation problems resulting from inadequate maintenance of the Naco, Sonora wastewater treatment facility.

Identifies that untreated wastewater from the Naco, Sonora facility regularly flows across the international boundary onto public and private property in Naco, Arizona due to capacity exceedances during equipment maintenance and other events.

Notes that the International Outfall Interceptor conveys wastewater from both Sonora and Arizona to the Nogales International Wastewater Treatment Plant, which is co-owned by the U.S. International Boundary and Water Commission and the City of Nogales.

Requests Congress enact legislation directing the U.S. section of the International Boundary and Water Commission to charge Nogales, Arizona an equitable proportion of operating and maintenance costs based on average daily wastewater volume, without requiring capital cost contributions from Nogales.

Directs the Arizona Secretary of State to transmit copies of the memorial to the President of the U.S. Senate, Speaker of the U.S. House of Representatives, and all Arizona Members of Congress.
