Proposes to amend Article XVIII of the Arizona Constitution by adding Section 11 to establish a fundamental right to engage in any occupation or profession.

Prohibits state laws or rules that regulate occupations unless the state proves by clear and convincing evidence that the prohibition or regulation is necessary to protect public health or safety.

Eliminates deference to administrative conclusions regarding occupational threats to public health or safety in enforcement actions or legal challenges.

Preempts all local occupational licensing ordinances, rules, and regulations by declaring occupational licensing a matter of statewide concern and prohibiting counties, municipalities, and other political subdivisions from enacting occupational licensing requirements.

Exempts criminal statutes from this section, but prohibits imposing criminal liability solely for failure to satisfy occupational or professional licensing requirements.
