HB 2024 Summary

• Amends the Smoke-Free Arizona Act to include electronic smoking devices in the definition of "smoking," making their use subject to the same restrictions as traditional tobacco smoking in public places and workplaces.

• Defines "electronic smoking device" to mean any device that delivers aerosolized or vaporized nicotine, including e-cigarettes, vape pens, e-cigars, e-hookahs, and related components or accessories.

• Creates an exception allowing retail stores that sell electronic smoking devices exclusively to permit their use if the store has independent ventilation preventing emissions from infiltrating smoke-free areas.

• Subjects violations of the electronic smoking device restrictions to the same civil penalties (not less than $100 but not more than $500 per violation) and enforcement mechanisms as traditional smoking violations.

• Requires enactment by an affirmative vote of at least three-fourths of the members of each house of the legislature per Arizona Constitution requirements.
