HB 2080 - Restoration of Civil Rights

• Transfers and renumbers section 13-912.01 to section 8-249, allowing persons adjudicated delinquent whose probation is completed to have firearm rights restored by the juvenile court judge.

• Establishes new procedures for restoration of civil rights for convicted felons, including automatic restoration for first-time offenders on final discharge if probation is completed and restitution is paid, and discretionary restoration for repeat offenders through court application.

• Prohibits firearm possession restoration for persons convicted of dangerous offenses; limits restoration for serious offenses to ten years after absolute discharge and two years for other felonies.

• Requires courts to inform defendants of their right to civil rights restoration at sentencing and mandates notification to the Department of Public Safety when civil rights are restored, with annotation in criminal history records.

• Applies restrictions to persons convicted of election fraud under section 16-1011, who shall not be automatically restored the right to vote regardless of civil rights restoration.
