Homeless minors may consent to receive housing or shelter services without parental or legal guardian consent, and such consent cannot be disaffirmed due to the minor's age.

Shelter, housing, and service providers are protected from criminal, civil, and professional disciplinary liability when they rely on a homeless minor's consent without obtaining parental or guardian permission.

"Homeless minor" is defined as anyone under 18 years old living apart from parents or guardians and lacking a fixed, regular nighttime residence, including those in shared housing, motels, shelters, vehicles, or abandoned buildings.

The definition includes migratory children as defined under 20 U.S.C. § 6399 who meet the homelessness criteria specified in the statute.
