HB2285 Summary

• Amends Arizona pharmacy benefit manager (PBM) regulations to require PBMs update drug pricing lists every 7 business days and disclose pricing sources to network pharmacies annually or at contract renewal.

• Establishes an appeal process allowing network pharmacies and pharmacy services administrative organizations to challenge PBM reimbursement rates for maximum allowable cost drugs.

• Prohibits plan sponsors and PBMs from blocking retail pharmacies from dispensing 90-day prescription fills when the pharmacy agrees to contractual terms and reimbursement rates, excluding Schedule II and III controlled substances.

• Prohibits plan sponsors and PBMs from preventing retail pharmacies from offering mail delivery or hand delivery of prescriptions as ancillary services within existing contracts.

• Requires pharmacies to disclose any delivery fees to patients and clarifies such fees may not be reimbursable by the plan sponsor or PBM, with exceptions for AHCCCS and its contractors.
