HB 2308 Summary

• Amends Arizona Revised Statutes section 28-337 regarding high occupancy vehicle (HOV) lanes and procedures for monitoring their operation when single occupancy vehicles are authorized to use them.

• Establishes a priority system for lane use when an HOV lane becomes degraded, in order: passenger vehicles with 2+ occupants, public transit buses, buses with 2+ occupants, motorcycles, alternative fuel vehicles, and low emission/energy efficient vehicles.

• Defines an HOV lane as degraded when vehicles fail to maintain 45 miles per hour or greater 90 percent of the time over 180 consecutive days during morning and evening weekday peak-hour periods.

• Requires the department to limit HOV lane use to the priority vehicle categories and maintain restrictions while the lane remains degraded.

• Makes technical corrections to statutory language including changing "per cent" to "percent" and "peak hour" to "peak-hour".
