HB 2443 Summary

• Amends Arizona Revised Statutes § 33-422 regarding affidavits of disclosure for the sale of unimproved land parcels in unincorporated county areas.

• Adds new Item 11 to the disclosure form requiring sellers to disclose whether the property or water used on the property is subject to a statement of claimant for water rights in a general adjudication of water rights.

• Renumbers subsequent disclosure items (former items 11-20 become items 12-21) to accommodate the new water rights adjudication disclosure requirement.

• Maintains existing requirements that sellers furnish the affidavit at least seven days before transfer, buyers have five days to rescind, and the executed affidavit must be recorded with the deed.
