HB 2492 Summary

• Amends Arizona Revised Statutes Section 28-672 to add violations of Section 28-710 (highway work zones) to the list of moving violations that can result in causing serious physical injury or death charges.

• Requires persons convicted under this section to attend and complete traffic survival school educational sessions approved by the department, with the court also authorized to order community restitution.

• Establishes driving privilege suspension periods: up to 180 days for first violations causing serious physical injury or up to one year if causing death; mandatory 180 days or one year suspension for second or subsequent violations within 36 months.

• Limits restitution awards to $100,000 and establishes a two-year prosecution time limit from when the offense was discovered or reasonably should have been discovered.

• Classifies violations as class 1 misdemeanors and names the legislation the "Jarvis K. Crenshaw Act."
