HB2550 - Kratom Consumer Protection Act

• Adds Article 10 to Title 36, Chapter 6 of Arizona Revised Statutes to regulate kratom products as food items containing parts of the mitragyna speciosa plant.

• Requires dealers selling kratom products to disclose on product labels the factual basis for representing a product as containing kratom, and prohibits sale of kratom products that do not comply with this disclosure requirement.

• Prohibits dealers from selling kratom products that are adulterated or contaminated with dangerous non-kratom substances, contain more than 2 percent 7-hydroxymitragynine in alkaloid composition, or contain synthetic alkaloids.

• Requires kratom products to include labeling showing the amount of mitragynine and 7-hydroxymitragynine contained and prohibits sales to individuals under 18 years of age.

• Establishes violations as Class 2 misdemeanors and allows private civil causes of action for damages; provides affirmative defense for dealers who relied in good faith on manufacturer representations.
