HCR 2012 Summary

• Requires all firearm sales and transfers to be conducted through a licensed firearms dealer unless both parties are already licensed dealers.

• Licensed dealers facilitating transfers must conduct federal background checks on purchasers/transferees and on sellers/transferors if delivery cannot be made, with dealers allowed to charge up to $20 in administrative fees.

• Provides exemptions for law enforcement, military personnel, gunsmiths performing repairs, common carriers, shooting range loans, family gifts between immediate family members, inheritance, antique firearms, and temporary transfers to prevent imminent death or bodily harm.

• Violators are subject to class 5 felony charges under Arizona state law.

• Requires voter approval through the next general election before becoming effective law.
