SB 1030 Summary

• Authorizes notaries public in Arizona to perform remote online notarizations using communication technology for individuals located in Arizona, elsewhere in the United States, or outside the United States under specified conditions.

• Requires the Secretary of State to adopt rules by July 1, 2020 establishing standards for remote online notarizations including communication technology, credential analysis, identity proofing, and audio/visual recording requirements.

• Mandates notaries performing remote online notarizations maintain electronic journals with tamper-evident format and retain audio/visual recordings of each remote notarial act for at least five years.

• Permits notaries to verify remotely located individuals' identities through personal knowledge, credential analysis combined with identity proofing, or credible witness oath or affirmation.

• Amends notary grounds for discipline to allow the Secretary of State to require notary training courses as an alternative to or in addition to suspending a notary's commission.
