SB 1137 Summary

• Establishes marijuana cultivated for medical use by nonprofit dispensaries and designated caregivers as an agricultural commodity regulated by the Arizona Department of Agriculture beginning June 1, 2020.

• Restricts pesticide use on medical marijuana to only products exempt from federal regulation under 40 CFR 152.25(f) minimum risk exemption.

• Requires third-party laboratory testing of medical marijuana and prohibits laboratories from having familial or financial relationships with the dispensaries or caregivers they test for.

• Appropriates $2,000,000 from the medical marijuana fund to the Department of Agriculture in fiscal year 2019-2020 to regulate marijuana as an agricultural commodity.

• Requires a three-fourths affirmative vote in both legislative houses for enactment pursuant to Arizona Constitution article IV, part 1, section 1.
