SB1161 Summary: School Facilities Revisions

• Creates annual list of vacant and partially used school buildings owned by the state or school districts, to be published by the school facilities board and made available to charter schools, private schools, and the public.

• Prohibits school districts from rejecting offers to sell or lease vacant/partially used buildings solely because a charter school or private school is the highest bidder, and requires districts to provide rationale for lease renewal increases.

• Allows school districts to sell used equipment to charter schools or private schools before disposing of equipment by other means.

• Exempts buildings used for career/technical education, special education, preschool, new schools (less than 5 years old), or magnet schools from "partially used" designation, with exemptions capped at 25% of a district's buildings.

• Increases lease and lease-purchase agreement thresholds from 15 to 20 years and removes election requirements for sales/leases of vacant buildings that have been unused for at least 3 years.
