SB 1307 Summary

• Changes the timing for when ignition interlock device requirements begin for DUI convictions to commence after a person successfully completes alcohol or drug screening, education, or treatment programs rather than upon license reinstatement or conviction report receipt.

• Modifies license reinstatement procedures for alcohol or drug-related revocations to allow the department to accept evaluations from physicians, psychologists, physician assistants, registered nurse practitioners, or substance abuse counselors performed within the previous twelve months instead of requiring current evaluations.

• Expands who can provide alcohol or drug screening to include substance abuse counselors as defined in section 28-3005, in addition to department of health services-approved facilities and probation departments.

• Clarifies that substance abuse counselors can be relied upon for evaluating whether a person can safely operate a motor vehicle following license revocation.

• Updates definitions in section 28-3315 to specify what constitutes a physician, physician assistant, psychologist, registered nurse practitioner, and substance abuse counselor for DUI-related licensing decisions.
