SB 1334 Summary

• Amends sentencing statutes to add a new mitigating circumstance allowing courts to consider whether a defendant has not previously received services through the state department of corrections or probation services for a felony offense in any state.

• Modifies repetitive offender sentencing provisions to require that historical prior felony convictions occur before the current offense date, unless the defendant was on release for a felony offense at the time of the present offense.

• Allows category one repetitive offenders to receive mitigated or aggravated sentences if at least two aggravating or mitigating circumstances apply, expanding sentencing flexibility for this offender category.
