Senate Bill 1352 Summary

• Transfers operation of the health care directives registry from the Secretary of State to a designated nonprofit health information exchange organization effective December 31, 2020.

• Requires the designated organization to establish processes for authenticating document submissions, maintaining security and privacy safeguards, and allowing persons to review, retrieve, revoke, and replace documents in the registry.

• Expands documents eligible for registry filing to include prehospital medical care directives and allows health information organizations to transmit documents to the registry with proper authentication procedures.

• Permits health care providers, emergency medical services personnel, and organ procurement organizations to access patient health care directives from the registry for provision of health care services.

• Requires the Secretary of State to transfer existing registry documents and contact information to the new organization by July 1, 2020, with the organization contacting submitters to determine if they want their documents transferred to the new registry.
