Reduces criminal penalty for possession of marijuana not intended for sale from a class 6 felony to a class 1 misdemeanor when the amount is more than 5 grams but less than 2 pounds.

Creates a new petty offense category for possession of 5 grams or less of marijuana, or 1/8 ounce or less of concentrated cannabis.

Adds a definition of "concentrated cannabis" as extracted or separated resin containing tetrahydrocannabinol or cannabidiol from marijuana.

Changes drug paraphernalia violation for marijuana possession from a class 6 felony to a petty offense when the violation involves 5 grams or less of marijuana.

Applies to Section 13-3405 as amended by both Laws 2010, chapter 194, section 6 and Laws 2018, chapter 287, section 2, with effective date of August 3, 2019.
