AZ SCR1021

Establishes marijuana cultivated by medical marijuana dispensaries and designated caregivers as an agricultural commodity regulated by the Arizona Department of Agriculture beginning June 1, 2021, subject to testing by independent third-party laboratories and limited to federally exempt pesticides.

Replaces criminal conviction exclusions for designated caregivers, dispensary agents, and officers with a requirement to obtain and maintain a valid fingerprint clearance card issued pursuant to title 41, chapter 12, article 3.1.

Extends registry identification card expiration from one year to two years for all cardholders and establishes a $100 renewal fee for registered qualifying patients.

Authorizes the department to deny, suspend, or revoke registrations for violations and assess civil penalties up to $5,000 per violation (maximum $25,000 per 30-day period), with factors including severity, patterns of noncompliance, and threats to health and safety.

Permits the department to publicly disclose inspection and compliance information for nonprofit medical marijuana dispensaries, including names, addresses, complaints, and enforcement actions.
