HB 2007 Summary

• Amends Arizona Revised Statutes Section 15-823 regarding admission of nonresident students to public schools and tuition requirements.

• Allows governing boards to admit nonresident students without tuition in specific circumstances including: children of university faculty/students, children placed with relatives for health reasons, foreign exchange students with J-1 visas (up to a set number), homeless children, Native American tribal members residing on cross-state reservation lands, and students in year-round residential boarding academies specializing in sports, music, or acting.

• Requires that nonresident students admitted under the cross-state tribal agreement provision who exceed reciprocal enrollment numbers be charged reasonable tuition, and that school districts pay tuition for their resident students admitted in excess numbers by other states.

• Specifies that nonresident students (except those covered under exchange programs, boarding academies, or certain reciprocal agreements) shall not be included in student count for state funding purposes.

• Requires parental execution of a notarized guardianship agreement as a condition of enrollment for nonresident students in year-round boarding academies.
