HB 2173 Summary

• Amends the Smoke-free Arizona Act to include electronic smoking devices and vaping in smoking prohibition by defining "electronic smoking device" as any device delivering aerosolized or vaporized substances, including e-cigarettes, e-cigars, vape pens, and e-hookahs.

• Expands the definition of "smoking" to include using electronic smoking devices that create aerosol or vapor and using oral smoking devices to circumvent smoking prohibitions.

• Adds "tobacco product" definition to include electronic smoking devices, substances intended for aerosolization or vaporization regardless of nicotine content, and related components and accessories.

• Removes exemptions for veterans and fraternal clubs and theatrical performances from smoking prohibitions, maintaining only exceptions for private residences (unless used as child care or health facilities), designated hotel/motel rooms, retail tobacco stores, religious ceremonies, and outdoor patios.

• Requires passage by three-fourths affirmative vote in both houses of the legislature per Arizona Constitution Article IV, Part 1, Section 1.
