HB 2303 Summary

• Amends Arizona Revised Statutes section 28-3511 to add two new exceptions to mandatory vehicle immobilization or impoundment requirements.

• Peace officers are not required to immobilize or impound a vehicle if the officer needs to be present at another location (subsection H).

• Peace officers shall not immobilize or impound a vehicle if there is a person in the vehicle who has a valid driver license and is able and willing to drive the vehicle (subsection I).

• These exceptions apply to all three situations requiring removal and immobilization or impoundment: driving with revoked/suspended privileges, driving without a valid license, driving with violation of ignition interlock requirements, and certain DUI-related violations.
