HB 2322 Summary

• Requires all firearm sales or transfers to be conducted through a licensed firearms dealer, unless both parties are already licensed dealers.

• When private parties sell or transfer firearms, the licensed dealer must conduct background checks on the purchaser under federal law (18 U.S.C. § 922(t)) and may charge a fee not exceeding $20 for administrative costs.

• If a purchaser fails the background check, the dealer must conduct a background check on the original seller; if the seller also fails, the dealer must deliver the firearm to the nearest law enforcement agency within 24 hours.

• Exempts law enforcement, military personnel, gunsmiths, common carriers, shooting range loans, lawful hunting loans, inheritance by non-prohibited possessors, antique firearms, and immediate family gifts from the dealer requirement.

• Violation of this section is classified as a class 5 felony.
