HB 2411 Summary

• Establishes separate distribution formulas for criminal justice surcharges based on offense commitment dates: offenses committed on or after January 1, 2019 follow one distribution (subsection D), while offenses committed before January 1, 2019 follow a different distribution beginning June 30, 2020 (subsection E).

• Allocates a portion of surcharges from pre-2019 offenses to the victims' rights fund (7.68%) and victim compensation and assistance fund (4.60%), which were not previously funded through the criminal justice enhancement fund.

• Updates the victims' rights fund in section 41-191.08 to include deposits from the new surcharge distributions, expanding funding for victim services and assistance programs.

• Modifies the department of public safety forensics fund to clarify sources of deposits related to both offense time periods and adjusts forensics fund allocations accordingly.

• Declares the act an emergency measure operative immediately to preserve public peace, health or safety.
