HB 2412 Summary

• Amends Arizona Revised Statutes Section 13-905 regarding the process for setting aside criminal convictions and restoring rights.

• Removes the prohibition that previously prevented setting aside convictions for traffic violations, making traffic offenses eligible for conviction set-aside under standard factors (offense nature, probation compliance, restitution status, elapsed time, age at conviction, etc.).

• Allows firearm possession rights to be restored upon conviction set-aside, except for persons convicted of serious offenses as defined in Section 13-706.

• Maintains existing restrictions preventing set-aside for dangerous offenses, sex offenses with sexual motivation findings, offenses requiring sex offender registration, and felonies involving victims under 15 years old.

• Requires the Department of Public Safety to annotate criminal records when convictions are set aside while preserving the underlying record and allowing consideration of set-aside convictions for fingerprint clearance card applications.
