HB2499 Summary

• Amends Arizona Revised Statutes section 9-511 to add requirements when a municipality exercises eminent domain to acquire a public utility business or enterprise.

• Requires the condemning municipality to assume all existing assets and contractual obligations associated with providing current and future utility service in the certificate of convenience and necessity being condemned, unless all parties agree otherwise.

• Voids as against public policy any contract entered into by the condemned utility within 60 days of receiving the municipality's purchase offer if the contract was made in bad faith and for the purpose of impeding condemnation.

• Makes various technical corrections to statutory language including replacing "which" with "that," "shall" with "does not," and updating punctuation and formatting.
