HB 2541 Summary

• Requires the Department of Health Services and Department of Economic Security to jointly develop a curriculum educating all persons employed in vulnerable adult care on recognizing signs of neglect and abuse, reporting responsibilities, and contact information.

• Mandates that health care institutions, group homes, and intermediate care facilities provide mandatory training using the developed curriculum to all employees caring for vulnerable adults, with initial completion before employment and annual updates starting January 1, 2021.

• Requires covered facilities to post information about reporting suspected neglect or abuse in conspicuous places accessible to employees and adopt nonretaliation policies protecting employees who report suspected abuse in good faith.

• Establishes a rebuttable presumption that any employment termination or adverse action occurring more than 180 days after an abuse report is not retaliatory.

• Directs curriculum development to include consultation with the Developmental Disabilities Planning Council, sexual and domestic violence advocates, aging organizations, and disability service providers.
