HB 2553 Summary

• Adds section 49-119 to Arizona Revised Statutes requiring the Department of Environmental Quality to adopt rules establishing energy efficiency standards for products sold in Arizona.

• Requires all energy efficiency standards to be based on and at least as stringent as the Energy Star program standards set by the U.S. Environmental Protection Agency and U.S. Department of Energy.

• Prohibits the sale of products in Arizona that are not Energy Star approved, except for product categories where no Energy Star approved alternative exists.

• Classifies violation of the energy efficiency standards requirement as an unlawful practice under Arizona consumer protection law (A.R.S. § 44-1522) with enforcement and remedies available under Title 44, Chapter 10, Article 7.
