HB 2657 - Adult Use Marijuana Regulation

• Establishes the State Marijuana Board within the Department of Liquor Licenses and Control to regulate adult-use marijuana sales, mirroring the structure and authority of the existing liquor board.

• Authorizes retail marijuana stores to begin selling marijuana to adults 21+ starting January 1, 2022, with up to 500 registrations issued over five years (75% to liquor store licensees, 25% to other applicants).

• Legalizes personal possession of up to one ounce of marijuana for adults 21+ (not more than 5 grams as concentrate) and prohibits public consumption, driving while impaired, and sales to minors.

• Creates a 16% wholesale tax on marijuana products sold to retail stores, with the first $300 million annually directed to school facility funding and remaining revenue to the state general fund.

• Automatically expunges records for marijuana possession convictions under current law and allows persons to petition for expungement of prior marijuana-related arrests and convictions.
