HCR 2018 Summary

• Requires all firearm sales or transfers between non-licensed individuals to be processed through a licensed firearms dealer who must conduct federal background checks under 18 U.S.C. § 922(t).

• Permits dealers to charge a maximum $20 administrative fee to the purchaser or transferee to cover costs of facilitating the transfer.

• Exempts law enforcement, military, gunsmiths, carriers, shooting range loans, lawful hunting/sporting loans, inherited firearms, antique firearms, and immediate family gifts from the background check requirement.

• Establishes that violations constitute a class 5 felony in Arizona law.

• Directs the Secretary of State to submit this measure to voters at the next general election for approval as a ballot proposition.
