AZ HCR2036

Proposes a constitutional amendment to Article II of the Arizona Constitution by adding Section 38, to be submitted to voters at the next general election.

Prohibits Arizona state and local jurisdictions from declaring themselves "sanctuary jurisdictions" through statute, regulation, ordinance, policy, or other procedure that restricts law enforcement cooperation with federal immigration authorities.

Prevents jurisdictions from restricting law enforcement from: (1) sharing or collaborating with federal, state, or local entities to determine immigration status unless it would impede a law enforcement investigation, or (2) complying with lawful notices, requests, or orders from the U.S. Department of Homeland Security under the Immigration and Nationality Act.

Preserves the ability of law enforcement to share information with crime victims regarding federal immigration assistance programs available to victims of crime.

Includes legislative findings that Arizona welcomes legal immigrants and that preventing law enforcement cooperation with federal immigration authorities undermines public safety and the rule of law.
