Senate Bill 1001 Summary

• Amends Arizona condominium (§33-1256) and planned community (§33-1807) statutes regarding assessment liens and payment notice requirements.

• Requires associations to provide semiannual statements of account to unit owners/members beginning January 1, 2021, unless assessments were paid annually before January 1, 2020 (then only annual statement required).

• Mandates monthly statements of delinquent account to members with unpaid assessments, late fees, fines or other costs and fees; statements must cease once full balance is paid or bankruptcy notice is received.

• Allows unit owners and members to opt for electronic delivery of statements if they maintain current email addresses with the association.

• Modifies delinquency notice language from "will be turned over" to "may be turned over" for collection proceedings and changes notice delivery from certified mail (return receipt requested) to first class mail.
