Senate Bill 1015 Summary

• Restricts pesticide use in medical marijuana cultivation to only products exempt from federal regulation under the EPA's minimum risk exemption (40 CFR 152.25(f))

• Requires nonprofit medical marijuana dispensaries to test all marijuana products for microbial contamination, heavy metals, pesticides, herbicides, fungicides, growth regulators, residual solvents, and potency before dispensing to patients beginning November 1, 2020

• Mandates dispensaries provide test results to patients on request and display signage informing patients of their right to receive certified independent third-party laboratory test results

• Establishes department authority to certify and regulate independent third-party laboratories with requirements including accreditation, quality assurance programs, chain of custody procedures, and independence from dispensaries and caregivers

• Requires three-fourths affirmative vote of both legislative houses for enactment pursuant to Arizona Constitution article IV, part 1, section 1
