Requires public educational agencies to provide parents of children with disabilities information about where to obtain independent educational evaluations and the agency's criteria, including reasonable cost limits.

Mandates that independent educational evaluations paid for by the public agency must conform to the same criteria used by the agency when initiating its own evaluations.

Allows public educational agencies to decline payment for independent educational evaluations that do not meet agency criteria, including cost limits, without holding a due process hearing, but requires the agency to demonstrate noncompliance if the parent files a due process complaint.

Establishes that public educational agencies must afford parents the right to independent educational evaluations in compliance with this section and federal regulations (34 Code of Federal Regulations section 300.502).

Directs the state board of education, in consultation with the department of education, to adopt rules establishing minimum standards for public educational agency criteria for independent educational evaluations.
