SB 1071 Summary

• Repeals Title 11, Chapter 7, Article 8 (gang and immigration intelligence team enforcement mission provisions) and sections 13-1509, 13-2928, 13-2929, and 41-1724 of Arizona Revised Statutes.

• Removes language from section 13-2319 (smuggling statute) that authorized peace officers to stop persons based on reasonable suspicion of civil traffic violations for smuggling investigations.

• Eliminates section 13-3883 provision allowing warrantless arrest based on a person committing any public offense that makes them removable from the United States.

• Removes entrapment affirmative defense provisions from sections 23-212 and 23-212.01 (employment of unauthorized aliens statutes).

• Deletes sections 28-3511 provisions requiring vehicle removal/impoundment when person transports or harbors aliens known to be unlawfully present in the United States.
