SB 1146 Summary

• Beginning in 2020-2021 school year, parents of students with seizure disorders may submit a seizure management and treatment plan developed with the student's physician to their school district or charter school.

• Seizure management plans must outline procedures to manage active seizures at school, identify available health care services, and be signed by both parent/guardian and the physician.

• School nurses must review submitted plans; if unavailable, the school district or charter school must designate an employee for this responsibility.

• School districts, charter schools, and school employees are immune from civil liability for good faith implementation of seizure management plans, except in cases of gross negligence, willful misconduct, or intentional wrongdoing.

• School nurses and all school employees with regular student contact must complete online instruction courses approved by the state board of education regarding seizure recognition and first aid, with the board required to approve a free course by December 1, 2020.
